These terms and conditions apply to your use of the True Blue Sheds website (truebluesheds.com.au), our shed design tools, and any quote you accept or order you place with True Blue Sheds ("we", "us", "our"). Please read them carefully. By using the website, requesting a quote, or placing an order, you agree to these terms.
Nothing in these terms limits any rights you have under the Australian Consumer Law or any other law that cannot be excluded.
1. Using our website
You may use the website and our design tools for your own personal or business purposes in connection with planning or buying a shed, garage, carport or related product from us. You must not use the website for any unlawful purpose, attempt to interfere with its operation, or copy, scrape or republish its content without our written permission.
The information on this website, including product descriptions, span tables, wind region guidance, delivery estimates and prices, is general in nature. We take reasonable care to keep it accurate and current, but details can change and every site is different. Always rely on your written quote and the engineering documents supplied for your building, not on general website content.
Our 3D shed designer, colour visualiser and template designs are planning tools. They show indicative layouts and colours only. Screen colours vary between devices and will not exactly match COLORBOND® steel or other finished materials. Ask us for a physical colour sample before you finalise your order.
2. Quotes
A quote is an offer to supply the goods described in it at the price stated. Each quote lists what is included, such as engineering, cladding, doors, accessories, delivery and any installation we have arranged. Anything not listed is not included.
A quote is valid for the period stated on it (usually 30 days). After that it may need to be re-priced. Steel prices, freight costs and engineering requirements can change, and we may withdraw or correct a quote before you accept it if it contains an error.
Prices are in Australian dollars and include GST unless the quote says otherwise.
3. Orders and payment
Your order is confirmed when you accept a quote in writing and we receive the deposit stated on it. The balance is payable as set out on your quote or invoice, and in any case before the goods leave the manufacturing plant unless we have agreed other terms in writing.
Every building we supply is custom engineered and manufactured for your site. Once manufacturing has begun we may not be able to cancel or change your order. If you ask to cancel or change an order after acceptance, we will tell you what costs have been incurred. Any refund will take those costs into account. This does not affect your rights under the Australian Consumer Law where goods are faulty or not as described.
4. Your site, approvals and engineering
We engineer each building to the wind region, terrain category, importance level and other site details you give us. You are responsible for making sure that information is accurate. If site conditions differ from what you told us, the engineering, price and lead time may change.
You are responsible for obtaining any council, planning or building approvals your project needs, and for engaging a building surveyor or certifier where required. We supply engineering certification and drawings to support your application, but we do not lodge applications on your behalf.
Slabs, footings and other foundations must be built to the engineering documents we supply. Foundations are not included in your quote unless it says so.
5. Delivery
Delivery times quoted are estimates based on current manufacturing and freight schedules. We will keep you informed, but we are not liable for delays caused by events outside our reasonable control, such as supplier shortages, weather, transport disruptions or delays in your approvals or payment.
Delivery is to the kerbside or the closest safe point a delivery truck can reach at the address on your order. You must provide safe access and be available, or have someone available, to accept and help unload the delivery. Additional charges may apply if a delivery cannot be completed because access was not available or the site was not ready.
Please check your delivery against the packing list as soon as it arrives and tell us about any shortages or transit damage as soon as possible, ideally within 7 days, so we can put them right quickly. Reporting later does not remove your consumer rights, but it can make it harder to resolve freight claims.
6. Title and risk
Ownership of the goods passes to you when we have received payment in full. Risk of loss or damage passes to you on delivery. We recommend you insure the goods from delivery.
7. Installation
Unless your quote includes installation, our buildings are supplied as kits for you or your builder to erect. Installation must follow the assembly instructions and engineering documents supplied with the kit. Building work may need to be carried out by a licensed builder under the laws of your state or territory.
If we recommend an installer, that installer is an independent contractor. Any agreement for installation is between you and the installer unless your quote from us expressly includes installation.
8. Warranties and the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
In addition, steel supplied with BlueScope COLORBOND® or ZINCALUME® cladding is covered by the BlueScope warranty applicable to that product and location. Warranty periods and conditions vary with the environment (for example coastal or industrial sites) and are set out in BlueScope's published warranty terms. We will help you with any BlueScope warranty claim.
Structural components are designed and certified to the engineering supplied with your building. Warranties do not cover damage caused by incorrect assembly, use outside the design loads, alterations, lack of maintenance, or events such as flood, fire or impact.
9. Liability
To the extent permitted by law, and subject always to the Australian Consumer Law, our liability for any claim relating to goods we supply is limited to repairing or replacing the goods, supplying equivalent goods, or refunding the price paid, at our choice. We are not liable for indirect or consequential loss, such as loss of profit, business interruption or the cost of works by others, except where the law says otherwise.
We are not responsible for the accuracy of information provided by third parties, including installers, certifiers and councils, or for the content of external websites linked from our site.
10. Intellectual property
The content of this website, our designs, drawings, engineering documents, photographs and the True Blue Sheds name and logo are owned by or licensed to us. You may use the drawings and engineering we supply for the building you have ordered. You may not otherwise copy or reuse them without our written permission.
COLORBOND®, ZINCALUME® and BlueScope® are registered trade marks of BlueScope Steel Limited. ShedSafe® is a trade mark of the Australian Steel Institute. They are used here to describe the materials and accreditation relevant to our products.
11. Privacy
We handle personal information in accordance with our Privacy Policy, which explains what we collect, how we use it and how you can contact us about it.
12. Changes to these terms
We may update these terms from time to time by publishing a new version on this page. The version in force when you accept a quote applies to that order. Changes to website terms take effect when published.
13. Governing law
These terms are governed by the laws of Tasmania, Australia, and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Tasmania and the courts entitled to hear appeals from them. This does not limit your right to bring a claim in your own state or territory where the law allows it.
